Practical Steps Superintendents Can Take Now To minimize risk, treat FOIA compliance as a core operational process: 1. Centralize intake and tracking of all requests. 2. Use standardized templates reviewed by legal counsel. 3. Implement a reliable calendar system for tracking statutory deadlines. 4. Document all communications with requestors. 5. Review redactions carefully and always cite specific statutory exemptions. 6. Establish clear protocols for producing electronic records and metadata. 7. Provide annual FOIA training for administrative staff.
Superintendents should involve legal counsel early for complex, sensitive, or high-volume requests. Good faith is important, but it does not shield districts from technical violations. Bottom Line: Strong FOIA procedures are now essential risk management. By centralizing processes, training staff, maintaining meticulous documentation, and consulting counsel when needed, superintendents can significantly reduce their district’s exposure to costly and time-consuming FOIA lawsuits while still fulfilling transparency obligations.
